Concluso l'acquisto delle mura, restava ancora aperto il problema dell'acquisizione del torrione dell'Annunziata di Porta San Gervasio e Protasio, restato di proprietà Demaniale. Di questo argomento si discusse a lungo nel Consiglio Comunale su proposta della Giunta nella seduta del 26 marzo 1872 alla presenza del sindaco Demetrio Del Prete che suggerì di inserire la spesa prevista di £. 2.100 nel bilancio di previsione del 1873. Occorreva fare in fretta perché, secondo quanto dichiarato dall'assessore Guerra, sembrava che l'Amministrazione del Regio Demanio fosse determinata a vendere il Torrione al migliore offerente. Trattandosi di un antico monumento «interessante la storia patria», era importante che il Comune se ne facesse carico. Il presidente mise quindi a partito la proposta della Giunta di stanziare «nel bilancio all'Art. 26 di questa categoria, la somma di £. 2.100 per l'acquisto della parte di Torrione della Ss.ma Annunziata attualmente di proprietà demaniale». Proposta accolta all'unanimità e approvata dal Consiglio Comunale. Sebbene la cifra fosse nel frattempo salita a £. 2.585, il Consiglio decise di portare avanti la pratica e d'avvertire il Demanio delle proprie intenzioni tramite l'Intendenza di Finanza di Lucca. Il 31 gennaio 1874 il sindaco Giorgetti riuscì a trasmettere al Prefetto la documentazione necessaria, compreso il decreto in ottemperanza alla legge sulle espropriazioni per causa di utilità pubblica (25 luglio 1865 n. 2359) per cui «ogni monumento storico e di antichità nazionale che abbia la natura di immobile può essere acquistato dallo Stato, dalle Province e dai Comuni previo atto di "espropriazione per causa di utilità pubblica"». Nel marzo del 1874 giunse anche il parere favorevole del Consiglio di Stato ed il 30 aprile di quell'anno fu trasmesso al Ministro Guardasigilli il decreto con cui l'espropriazione del torrione veniva dichiarata di pubblica utilità. Atto risolutivo perché il Municipio potesse acquistare l'immobile e provvedere alla sua conservazione. Con questo recupero Lucca completò l'acquisizione di tutte le sue mura per destinarle a uso pubblico.

Once the walls had been acquired, the question remained of acquiring the torrione dell'Annunziata of St. Gervasio and Protasio Gate (Tower of Our Lady of the Annunciation), still owned by the State. This matter was discussed at length by the Town Council on a Committee proposal at the meeting of 26 March 1872 in the presence of the mayor Demetrio Del Prete, who suggested including the envisaged expense of Liras 2,100 in the forecast budget for 1872. Time was of the essence because, as councillor Guerra said, it seemed that the Royal State Property Administration was determined to sell the Tower at the best offer. In the case of an ancient monument «concerning the history of the fatherland», it was important for the Council to take charge. The chairman thus put forward the Committee proposal to allocate «in the budget under Art. 26 of this category, the sum of Liras 2.100 for the purchase of the part of the Tower of Our Lady of the Annunciation currently owned by the State». The proposal was unanimously accepted and approved by the Town Council. Although the sum had increased in the meantime to Liras 2,585, the Council decided to continue with the procedure and notify State Property of its intentions, through the Intendenza di Finanza (Lucca Revenue Office).
On 31 January 1874 mayor Giorgetti succeeded in sending the Prefect the necessary documents, including the public use decree, in compliance with the law on expropriation for public use (25 July 1865 N° 2359) by which «any historic monument or monument of national antiquity, in the form of a building or construction, may be acquired by the State, Provincial Authorities and Town Councils, subject to an act of "expropriation for reasons of public use"». March 1874 brought the State Council's favourable opinion and on 30 April of the same year the Minister of Justice was sent the decree which stated that expropriation of the Tower was of public use. A resolutive act enabling the Town Hall to acquire the building and arrange for its preservation. This recovery enabled Lucca to complete the acquisition of all its walls, assigning them for public use.
